What Is a No Objection Certificate?

An NOC is a formal document in which an authorized person or organization states that they do not object to a particular action being taken by another party. It's typically required when a third party's consent must be documented before proceeding.

When an NOC Is Typically Required

  • Employer NOC — for moonlighting, higher studies, visa applications
  • Property NOC — from society, co-owners, or legal heirs for sale/mortgage
  • Vehicle NOC — from RTO before inter-state transfer of a registered vehicle
  • Bank NOC — confirming loan closure and no outstanding dues

Mandatory Elements of a Valid NOC

  1. Letterhead (if from a company/institution) — with name, address, registration details
  2. Date of issue — exact date in DD/MM/YYYY format
  3. Reference number — optional but recommended for official NOCs
  4. To/From details — addressed to the receiving authority or person
  5. Subject line — clearly states the purpose of the NOC
  6. Details of the no-objection party — full name, designation, relationship to matter
  7. Details of the subject (person/property/vehicle) — to whom the NOC applies
  8. Explicit no-objection statement — "we have no objection to..."
  9. Specific scope — what action is being approved (sale, transfer, employment, travel)

Reference Number Matters

Always include a unique reference number (e.g., "NOC/HR/2026/0145") on corporate NOCs. Receiving departments often quote this number back when asking for verification — essential for smooth processing.

Employer NOC — Format and Sample

An employer NOC is the most common type. Required for: passport application, visa application, higher studies admission, second job/consulting, background verification.

Vehicle NOC (Form 28) for RTO Transfer

When you move your registered vehicle from one state to another, the original RTO must issue an NOC (Form 28) before the destination RTO can re-register it.

When Vehicle NOC Is Required

  • Inter-state transfer (Delhi → Bangalore for work relocation)
  • Sale of vehicle to buyer in another state
  • Permanent relocation with personal vehicle

Documents Needed for Vehicle NOC

  1. Form 28 (3 copies, duly filled)
  2. Original RC (Registration Certificate)
  3. Valid PUC (Pollution Under Control) certificate
  4. Valid insurance certificate

Validity

Vehicle NOC is valid for 6 months from date of issue. Destination RTO must re-register the vehicle within this window or the NOC lapses and you must reapply.

Road Tax Rules

Many states require you to pay full road tax in the destination state even if you have already paid it in the origin state — the NOC process does not auto-refund original road tax. Some states allow refund after destination re-registration; file the refund claim promptly.

Property NOC — Society, Co-owner, and Heir

Society NOC

Required before: sale of flat, mortgage to bank for home loan, rent agreement registration. Issued by the housing society secretary/chairman confirming no dues to society and no objection to the action.

Co-owner NOC

If property is jointly owned, all co-owners must sign an NOC consenting to sale/mortgage. Missing any co-owner's NOC makes the transaction legally void.

Legal Heir NOC

When selling inherited property, all legal heirs (as per Hindu Succession Act or personal law) must issue NOCs waiving their claim — or a succession certificate/legal heir certificate from the court is required as substitute.

Bank NOC After Loan Closure

When you close a home loan, car loan, or personal loan, the lending bank must issue an NOC confirming full closure and zero outstanding dues. This NOC is critical for:

  • Removing lien on property — for home loans, lender holds original property documents as security
  • RC hypothecation removal — for vehicle loans, RTO removes the "HYP" entry on RC
  • CIBIL closure — ensures loan shows "Closed" status in credit reports
  • Future loan applications — lenders check for prior loan closures

What to Verify in a Loan Closure NOC

  • Loan account number and type
  • Principal amount and closure date
  • Statement of "no outstanding dues as on [date]"
  • Return of original documents (property deed, blank cheques, post-dated cheques)
  • Hypothecation cancellation (for secured loans)
  • Form 35 (for vehicle loans) to be submitted to RTO
Pre-Pay vs Close

Paying the final EMI does not automatically issue an NOC. You must explicitly request "loan closure" from the bank branch — receive the NOC in writing, get original documents back, and verify CIBIL reflects "Closed" status within 45 days.

Travel NOC for Minor Children

When a minor (under 18) travels abroad without both parents, airlines and immigration officers often require an NOC from the non-travelling parent(s).

When Travel NOC Is Required

  • Minor travelling alone (as unaccompanied minor)
  • Minor travelling with only one parent
  • Minor travelling with grandparents, uncle/aunt, school group
  • Divorced parents: non-custodial parent's NOC often required

Stamp Paper Rules

Most NOCs do NOT require stamp paper — they're issued on letterhead or plain paper. Exceptions:

  • Property transfer NOCs — often require stamp paper (INR 50-500 depending on state)
  • Inter-state vehicle NOCs — specific state stamp rules apply
  • Legal heir waiver NOCs — usually on INR 50-100 stamp paper

Corporate NOCs from employers, banks, and societies are on their respective letterheads and do not need stamp paper.

Frequently Asked Questions

Is an NOC legally binding?+

Yes, once signed by an authorized person and issued on proper letterhead/stamp paper. It cannot be arbitrarily revoked within its validity period. Courts have held that a properly issued NOC creates an enforceable waiver.

Can an NOC be cancelled after issuance?+

Only with valid reason and written notice to the recipient before they've acted on it. Once the receiving party has relied on the NOC (e.g., applied for visa, begun a sale), revocation typically requires mutual consent.

How long does it take to get an NOC from an employer?+

Typically 3-7 working days for standard HR NOCs (visa, higher studies). Urgent requests can be processed in 24-48 hours. Employers cannot unreasonably delay NOCs for employees in good standing.

Can I write my own NOC?+

Only if YOU are the issuing party. For example, as a co-owner of property, you can write your own NOC waiving objection. NOCs required FROM another party (your employer, your society) must come from them, not self-written.

Does an NOC need to be on stamp paper?+

Usually not. Most NOCs from employers, banks, and societies are on letterhead without stamp paper. Property transfer NOCs and some legal heir NOCs require stamp paper (INR 50-500) depending on state.

What if my employer refuses to issue an NOC for visa?+

There is no legal obligation to issue visa NOCs, but most companies do as standard practice. If refused, the visa officer will typically accept an employment verification letter stating you're on leave with company approval. Keep all communication in writing.

Is a vehicle NOC needed for selling within the same state?+

No. Vehicle NOC (Form 28) is only required for inter-state transfer. Within the same state, only Form 29/30 (transfer of ownership) is needed at the RTO.

What is the fee for a bank NOC after loan closure?+
